Requirements for vaping and other notifiable products

This page provides a list of vaping products that are prohibited for sale as they are not compliant with legislative requirements. 

Information on changes the Government has made to the Smokefree Environments and Regulated Products Act 1990 and when they came into effect.

Retailers who sell vaping, heated tobacco and herbal smoking products must comply with requirements set out in the Smokefree Environments and Regulated Products Act and their Regulations. Read more to understand your obligations as a retailer of notifiable products. 

Manufacturers, importers, distributors and retailers of vaping and other notifiable products must keep sales records and provide annual returns.

Manufacturers, importers, and retailers of notifiable products (vaping, smokeless tobacco and herbal smoking products) and distributors of smoked tobacco products must provide annual sales returns to the Ministry of Health each year.

All vaping substances must meet packaging and labelling requirements to ensure compliance with regulations.

To minimise the appeal of vaping products to children and young people, certain restrictions apply to their flavours and colours.
