About the Smokefree Environments and Regulated Products (Smoked Tobacco) Amendment Act

The Smokefree Environments and Regulated Products (Smoked Tobacco) Amendment Act 2022 (the Act) came into force on 1 January 2023. While some provisions have since been repealed, the below changes were introduced by the Act and remain in place.

The related Smokefree Environments and Regulated Products Amendment Regulations 2023 have now been published.

1 January 2023 (SERPA provisions came into force)

  • Retailers of Smoked Tobacco Products must no longer solely rely on statement (given oral or in written form) that a person is over 18 years old
  • Retailers of Smoked Tobacco Products must keep accurate records relating to all their regulated products
  • Distributors of Smoked Tobacco Products must keep accurate records relating to all their regulated products
  • NZ Manufacturers & Importers of Smoked Tobacco Products must keep accurate records relating to all their regulated products
  • Exporters of Smoked Tobacco Products must keep accurate records relating to all their regulated products

1 October 2023 (9 months after Act commenced)

  • Distributors of Smoked Tobacco Products must have notified that they sell smoked tobacco products at wholesale.
