Government will not appeal decision on the Paid Family Caregivers case

On 14 May 2012 the Court of Appeal confirmed that the Ministry of Health's policy prohibiting close family carers from being eligible to be paid to provide care for their adult disabled children is a form of discrimination that cannot be justified.

The government accepts the conclusion of the Court of Appeal which means that the Ministry of Health’s current policy needs to change. 

The Ministry of Health has established a Technical Advisory Group consisting of experts from the disability sector including carers, people with disabilities and disability service providers to provide expert advice to the Ministry of Health in the revision of the policy.

The Ministry has announced the membership and Terms of Reference of the Technical Advisory Group on issues arising from the family carers litigation.

The group has a mix of people, including people with disability (and experience of needing care), experience of being family carers, and people with a detailed understanding of the current system for providing disability support services.
